MP HC quashes assault FIR against Bhopal ADRM who was transferred to Chennai, 'attempt to harass ADRM because of his senior position' states judgement

Bhopal: The High Court has quashed the case of rape for which the Bhopal Railway Division was heavily criticized nine months ago. Justice Sanjay Dwivedi's single bench, through its order, ended all the action including the FIR lodged by the police, finding it unfair. In fact, the woman who had complained of rape was working in the Bhopal Railway Divisional Office and the allegations were leveled by her not on anyone else, but on ADRM Gaurav Singh, who was one notch below the DRM in Bhopal Railway Division. The police had registered a case against the ADRM in this matter without delay. Not only this, before the investigation was completed, the Railway Board had also transferred the ADRM to Chennai. At that time, people had fiercely questioned the Railways in this whole matter.
It is worth mentioning that the woman, who filed a case of rape against the petitioner Singh, had accepted that she had made false allegation of rape after being fed up of her husband's harassment and to save her married life. After considering this statement, the High Court made it clear in its remarks that the woman had a bad relationship with her husband from the beginning, whose complaint she had lodged with the Harda and Narmadapuram police. After the death of the woman's father, she was contacted by ADRM Bhopal Gaurav Singh regarding the case related to compassionate appointment. After which the woman got a job in the railways. The woman had alleged that ADRM raped her after making her stay in the retiring room of Bhopal railway station. But the evidence was not presented during the hearing. The court also raised questions on the action of Harda, Govindpura police and Narmadapuram police and said that when the woman was already complaining of assault and ill-treatment against her husband, then why no action was taken in that case. On the contrary, as soon as the woman accused the ADRM of rape under the pressure of her husband, a case was immediately registered against the senior railway officer. The woman had first lodged a complaint against her husband with the Harda police. The High Court said in its order that it appears that an attempt has been made to harass the ADRM because of his senior position. Hence, the case is being quashed.
